2019 Sealed Bid Bison Sale

 

Sealed bid information:

● The Platte River Whooping Crane Maintenance Trust Inc. referred to hereafter as the “Crane Trust”, is selling 16 yearlings and 4 two-year-old male bison.

● The sealed bids will be accepted through the mail, email, and/or fax and received no later than Monday, October 28th, 2019 at 5:00 pm CST.

● Mail, email, or Fax bid to 6611 W Whooping Crane Drive Wood River, NE 68883.

● The successful bidder(s) will be notified by October 30th, 2019. The successful bidder(s) must make a 20% down payment within 7 days of being notified.

● The successful bidder(s) will have between November 21st and November 24th, 2019 to pick up the bison from the Crane Trust corrals located at 6611 Whooping Crane Drive Wood River, NE 68883.

● The successful bidder(s) will be responsible for the cost of all required tests for interstate transport and their respective state requirements. The Crane Trust will allow additional testing to be conducted within our corral system.

● The successful bidder(s) will provide 100% of the final cost at the time of pickup and payable to: ‘Crane Trust’.

Additional Information:

The Crane Trust will sell the above-identified bison to the highest successful bidder(s). The Crane Trust has the absolute right to reject all sealed bids and re-advertise for proposals. That as to the default obligations and liquidated damages contained herein and in submitting its bid as required by this notice, the successful bidder(s) acknowledges and agrees that:

● at time of submitting its bid, the damages to be suffered by the Crane Trust in the event of default of purchaser are incapable, impractical and/or very difficult to accurately estimate due 2 to the many variables and possible expenses and damages to be incurred by the Crane Trust in mitigating its damages;

● due to the nature of the variables and possible expenses and damages to be incurred by the Crane Trust that the provisions contained hereafter constitute a reasonable endeavor by the parties to fix fair compensation to the Crane Trust for the default of successful bidder(s);

● the liquidated damages provided for herein bear a reasonable relation to the probable damages incurred by the Crane Trust and are not disproportionate to those reasonable, anticipated by successful bidder(s) and the Crane Trust;

● in the event successful bidder(s) defaults in performance of its obligation, successful bidder(s) and the Crane Trust agree that in their endeavor to fix a fair compensation to the Crane Trust, the damages suffered by the Crane Trust are equal to the negotiated price submitted by successful bidder(s) with their bid and that the Crane Trust is authorized to and shall retain such sum in total as liquidated damaged in full settlement of any and all damages it may suffer as a result of successful bidder(s) default;

● in the event that the Crane Trust is unable to complete the delivery of its bison as provided herein for reasons beyond its control, the Crane Trust shall refund, without interest, the deposit to the successful bidder(s) which shall relieve the Crane Trust of all obligations and responsibilities to successful bidder(s).
